📜 Agreement to Terms

Welcome to Baby Milestone Tracker. By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

👤 Account Registration

Creating an Account

To use certain features of the App, you may need to create an account. When you do:

• You must be at least 18 years old or the age of majority in your jurisdiction
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities that occur under your account

Account Security

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

✅ Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates any applicable law or regulation
• Upload content that is harmful, threatening, abusive, or invasive of privacy
• Upload content that you don't have the right to share
• Attempt to gain unauthorized access to the App or its systems
• Use the App to transmit viruses, malware, or other harmful code
• Interfere with or disrupt the App or servers
• Use automated means to access the App without permission
• Impersonate another person or entity

📸 Your Content

Ownership

You retain full ownership of all photos, text, and other content you create or upload to the App ("Your Content"). We do not claim ownership of Your Content.

License to Us

By using the App, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the App's services to you. This license:

• Is limited to what's necessary to operate the App
• Does not include the right to sell or share Your Content with third parties
• Ends when you delete Your Content or your account

Your Responsibilities

You are responsible for ensuring you have the right to upload any content to the App. You represent that Your Content does not violate any third-party rights.

💳 Subscriptions & Payments

Free and Premium Features

The App offers both free features and premium subscription plans. Free features may be used without payment. Premium features require an active subscription.

Subscription Terms

• Subscriptions are billed on a recurring basis (monthly or annually)
• Payment is processed through Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel your subscription at any time through your device's app store settings

Refunds

Refund requests are handled by Apple or Google according to their respective policies. We cannot process refunds directly. Please contact Apple Support or Google Play Support for refund requests.

Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of your next billing period following notice of the change.

🔒 Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

🔧 App Updates & Changes

We reserve the right to:

• Update, modify, or discontinue any features of the App at any time
• Release new versions of the App that may require updates
• Change or discontinue free features or convert them to premium features

We will make reasonable efforts to notify you of significant changes that affect your use of the App.

📱 Third-Party Services

The App may integrate with or link to third-party services, including:

• Canva: For scrapbook export and design creation
• Cloud Services: For optional backup and sync features
• Analytics Services: For app improvement (with your consent)

These third-party services are governed by their own terms and privacy policies. We are not responsible for the content or practices of third-party services.

App Provided "As Is"

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free.

Medical Disclaimer

Data Loss

While we take reasonable precautions to protect your data, we are not responsible for any loss of data due to device failure, app malfunction, or other circumstances beyond our control. We strongly recommend enabling cloud backup and/or regularly exporting your data.

⚖️ Limitation of Liability

To the maximum extent permitted by law, Baby Milestone Tracker and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, use, goodwill, or profits.

Our total liability for any claims arising from or related to these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

🤝 Indemnification

You agree to indemnify and hold harmless Baby Milestone Tracker and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another.

🚫 Termination

We may terminate or suspend your account and access to the App at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the App will immediately cease
• You may export your data before termination if possible
• Provisions of these Terms that by their nature should survive will survive

You may terminate your account at any time by deleting your account through the App settings.

🌍 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

📝 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of this page
• We will notify you of material changes via email or in-app notification
• Continued use of the App after changes constitutes acceptance of the new Terms
• If you disagree with changes, you should stop using the App
