1. Acceptance of Terms

By accessing or using Baby Milestone Tracker ("the App"), including our website at babymilestonetracker.com ("the Website"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App or Website.

2. Description of Service

Baby Milestone Tracker is a mobile application and companion website that helps parents and caregivers track, record, and preserve their child's developmental milestones, photos, videos, journals, and growth data from birth through kindergarten.

3. User Accounts

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate and complete information when creating your account.
• You must notify us immediately of any unauthorized use of your account.

4. User Content

You retain ownership of all content you upload to Baby Milestone Tracker, including photos, videos, audio recordings, journal entries, and other materials ("User Content").

By uploading User Content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you and any family members you choose to share with.

We do not sell, share, or use your User Content for advertising or any purpose other than delivering the service.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Upload content that infringes on the intellectual property rights of others.
• Attempt to gain unauthorized access to the App, its servers, or any related systems.
• Interfere with or disrupt the integrity or performance of the service.
• Use the App to store or transmit malicious code or harmful content.

6. Subscriptions and Payments

Baby Milestone Tracker offers both free and premium subscription tiers. Premium features are available through in-app purchases managed by Apple App Store or Google Play Store.

Subscription terms, pricing, and renewal policies are presented at the time of purchase and are subject to the terms of the respective app store. Refund requests should be directed to the app store where the purchase was made.

7. Family Sharing

The App allows you to share milestone data with family members. You are responsible for managing who has access to your family's data. By inviting a family member, you authorize them to view and contribute to the shared content.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information and User Content.

9. Service Availability

We strive to keep Baby Milestone Tracker available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice when possible.

10. Limitation of Liability

To the maximum extent permitted by law, Baby Milestone and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or Website.

Our total liability for any claims related to the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.

11. Termination

You may delete your account at any time through the App settings. We may terminate or suspend your account if you violate these terms.

Upon termination, we will provide a reasonable period to export your data. After that period, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes through the App or by email. Your continued use of the service after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration.
